The Credit Originator
The consumer initiates the relationship with the credit originator by signing an agreement to receive goods or services in exchange for promise of payment subject to specific terms and conditions.
4. Post Write off
Once the account has been written off, the credit originator attempts to recover the loss through the use of collection law firms, collection agencies and/or repossession companies. These companies are typically compensated by a portion of whatever they recover.
2. Delinquency
Typical credit agreements require, at minimum, a payment over a specific period of time, usually measured in months. When a minimum payment is not made, the consumer’s account “ages” in terms of delinquency, for example, 2 months past due.
5. Asset Sale
At any time during the recovery process the credit originator has the option of selling the debt to a third party. Debt buyers are regulated by federal and state laws in the U.S. and provincial laws in Canada. Debt buyers are either active- they perform their own recovery effort; or passive- they work with collection lawyers or agencies.
3. Default
Once the account ages to a specified period of time, usually six months past due, the account is considered in default, and the debt is written off by the credit originator. This is an accounting treatment representing the lower likelihood of the debt’s repayment.
6. Working with a Debt Buyer
Debt buyers have complete autonomy to resolve the consumer’s account. They have the ability to tailor a re-payment solution that suits the consumer’s need, or a settlement solution to permanently resolve the amount owed. The debt buyer should communicate with the consumer in the manner that suits the consumer’s preference.
